Who Should Enforce the Digital Services Act? (Center for Data Innovation)

The EU’s Digital Services Act (DSA) will create new transparency and accountability rules for online services. The DSA would continue the principle enshrined in the eCommerce Directive that online services are subject to the law of the member state where they are established. However, some member states have proposed changing the DSA so that member states can enforce rules for any online intermediary providing services in their country. The purpose of this change would be to prevent underenforcement but the risk is that this change would create fragmentation of the Digital Single Market.

The Center for Data Innovation hosted a panel discussion on the enforcement framework in the DSA, the role of the Member States and the Commission, and how the European Parliament should address these issues.
