DHS Warrantless Home Entry Memo’s Fourth Amendment Problem

(Hannah James – Just Security) In an internal memo made public through a whistleblower report, the Acting Director of Immigration and Customs Enforcement (ICE) instructed ICE officers that they are permitted to enter homes to conduct immigration arrests without judicial authorization. This instruction is not only a departure from longstanding Department of Homeland Security (DHS) policy, but also contrary to core Fourth Amendment rights that protect both citizens and noncitizens within the United States.
